     While many individuals view filing any bankruptcy case to be a negative event, bankruptcy attorney Mark Herder believes that filing a Chapter 13 bankruptcy case may help a person take control of his or her economic crisis and facilitate financial empowerment!   In addition to erasing most unsecured debts, ending creditor harassment and eliminating the stress associated with an imbalanced economic environment, some of the primary benefits of filing a Chapter 13 bankruptcy case include:
  • Foreclosure sales of real estate may be stopped;
  • Repossessions of vehicles and automobiles may be prevented;
  • Federal (IRS), state and local tax problems may be managed and resolved;
  • Struggling businesses may be rehabilitated;
  • Significant assets may be sheltered and protected;
  • Unmanageable debts may be restructured; and,
  • Unaffordable and oppressive student loan payments may be forestalled (though nondischargeable).
     A chapter 13 bankruptcy petition filing is often an appropriate solution for a debtor who simply needs some breathing room and a reasonable time to catch up on payments.   At the law office of bankruptcy attorney Mark Albert Herder, we work exceptionally hard to minimize the monthly Chapter 13 payment to the Chapter 13 Bankruptcy Trustee.  We are extremely aggressive in asserting the legal rights of our clients.  To reference many of the required materials and documents to start any bankruptcy proceeding, please access our Links And Resources Section!
COLUMBUS CHAPTER 13 BANKRUPTCY
     Among many other features, Chapter 13 of the United States Bankruptcy Code offers individuals an opportunity to save their home from foreclosure and protect their vehicle from repossession.  It usually enables individuals with regular and consistent income to develop a plan to keep their property while repaying only a very small portion or fraction of their debts.  Under Chapter 13 bankruptcy, debtors propose a plan to make monthly installments to a Chapter 13 Bankruptcy Trustee over a period of time of three to five years (36 to 60 months).
